Booking Terms & Conditions
High Performance Travel Limited
Version 2.1 · Effective 22 August 2026 · Legal & Trust · Privacy Policy
These are the terms you agree to when you book with us. You can read them here before you commit to anything. When you book, you will be asked to accept them in your client portal, where the version and date you accepted are recorded.
Version 2.1 · Effective 22 August 2026
1. Introduction
Please read the following terms and conditions carefully. You must not make any booking unless you understand and agree with the following terms and conditions. These terms and conditions apply to bookings you make with the NZ Travel Broker (Tony Ujdur — High Performance Travel) that you have engaged ("we", "us", "our"); in person, on the phone, by email, or through any digital channel including our website and client portal.
We will rely on the authority of the party making a booking to act on behalf of any other party involved, and the party making the booking will bind all involved travellers to these terms and conditions.
2. Service Commitment
Your NZ Travel Broker will provide services with a commitment to deliver them with reasonable care and skill, fit for purpose, charged at a reasonable price, and completed within a reasonable time, consistent with our obligations under the Consumer Guarantees Act 1993.
3. Agency
We act as an agent for, and sell various travel-related products as an agent on behalf of, transportation, accommodation, event, and other service providers — such as airlines, coach, rail and cruise line operators, hotels, motorsport event promoters, golf course operators, and wholesalers.
Any services we provide to you are collateral to that agency relationship. Our obligation to you is to (and you expressly authorise us to) make travel bookings on your behalf and to arrange relevant contracts between you and travel service providers. We exercise care in the selection of reputable service providers, but we are not ourselves a provider of travel services and have no control over, or liability for, the services provided by third parties.
All bookings are made on your behalf subject to the terms and conditions, including conditions of carriage and limitations of liability, imposed by these service providers. We can provide you with copies of the relevant service provider terms and conditions on request.
Your legal rights in connection with the provision of travel services are against the specific provider and, except to the extent a problem is caused by fault on our part, are not against us. Specifically, if for any reason (excluding fault on our part) any travel service provider is unable to provide the services for which you have contracted, your rights are against that provider and not against us.
4. Prices and Quotations
All prices are subject to availability and can be withdrawn or varied without notice. The price is only guaranteed once paid for in full by you. Quoted prices may change before payment by reason of matters outside our control which increase the cost of the product or service. Such factors include adverse currency fluctuations, fuel surcharges, taxes, supplier tariff increases, and airfare increases.
Prices will be quoted in New Zealand dollars unless specifically stated otherwise. Where line items in a quotation reference a foreign currency, the New Zealand dollar equivalent is calculated at the time of quotation and may differ at the time of payment.
5. Deposits
You will be required to pay a deposit or deposits when booking. Your NZ Travel Broker will advise these amounts and when they are due. All deposits are non-refundable for cancellations made by you. Where a deposit has already been paid to a third-party supplier on your behalf, our ability to recover that deposit on your behalf is governed by the supplier's terms.
6. Final Payment
Final payment will be required up to 90 days prior to departure unless otherwise stated. Some airfares or services must be paid in full at the time of booking. Specific payment due dates will be confirmed in your booking documentation.
7. Payments
Payment by credit card: a surcharge applies, equal to the merchant fee charged to us by our payment provider for the card type used. We accept Visa, MasterCard, American Express, Q Card, Q MasterCard, Debit Card, GEM Visa, and Farmers Card. The applicable surcharge rate will be disclosed before you confirm payment. You authorise us to charge all fees incurred by you in relation to the services provided to your nominated card. If payment is not received from the card issuer or its agent for any reason, you agree to pay us all amounts due immediately on demand.
Payment by direct credit or cash: funds are required to be deposited into the NZ Travel Brokers Trust Account at least 24 hours prior to the final payment due date to allow time for cleared funds to appear.
Bank account details: the account to pay into, and the exact Particulars, Code and Reference to quote, are printed on your invoice. Please use the references shown there — they are unique to your booking and are how your payment is matched to it. Funds are held in the NZ Travel Brokers Limited Client Trust Account with BNZ; NZ Travel Brokers is listed in the New Zealand banking system as an approved payee.
8. Amendment and Cancellation Fees
Cancelled bookings will incur service fees and charges, including supplier fees. These can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Service fees, charges, and supplier fees will also apply where a booking is amended, changed, or tickets or other travel documents are re-issued.
Where we incur any liability for a cancellation fee or charge for any booking which you cancel or amend, you agree to indemnify us for the amount of that fee or charge in addition to any service fee we charge. The applicable fees and charges will be advised at the time of quoting and booking.
Group bookings: where a member of a group booking cancels, the remaining travellers may be required to pay a revised per-person rate to account for changes to accommodation, transport, or supplier minimum-party charges. We will advise of any such revision before confirming amendments.
9. Travel Insurance
We strongly recommend that you take out appropriate travel insurance to cover your travel arrangements. For all international travel, comprehensive travel insurance is essential. Your insurance protection should include cover for cancellation, medical and repatriation expenses, personal injury and accident, death and loss of personal baggage and money, and personal liability insurance.
You acknowledge that you have been advised of the importance of travel insurance and that you are required, prior to departure, to either:
- confirm to us that you have obtained appropriate travel insurance and provide policy details on request, or
- expressly acknowledge in writing (including by electronic acknowledgement in our client portal) that you have declined to obtain travel insurance, and accept full responsibility for any losses, costs, or liabilities arising from that decision.
We do not provide travel insurance. We can provide you with information about insurance options on request.
10. Travel Documentation
Travel documents include, without limitation, airline tickets, hotel vouchers, tour vouchers, event tickets, and any other document, in electronic form or otherwise, used to confirm an arrangement with a service provider. They may be subject to certain conditions and/or restrictions including, without limitation, being non-refundable, non-changeable, subject to cancellation and/or amendment fees, and non-transferable to another person.
All airline tickets must be issued in the name of the passport or photo identity holder, and used in segment order. Tickets used out of sequence may result in onward flights being cancelled by the airline.
An incorrect name on a booking may result in an inability to use that booking and the booking being cancelled. Please review your travel documentation carefully and immediately advise us of any errors in names, dates, or timings.
11. Taxes and GST
Goods and Services Tax (GST) at the current New Zealand rate of 15% applies to our service fees and to domestic supply of goods and services where applicable. International airfares and certain international supplier services are zero-rated for GST purposes. Your quotation and invoice will identify GST-inclusive and GST-exclusive components clearly.
Certain taxes are mandatory in various countries. There may also be additional local taxes charged at some airports and hotels (resort fees, tourism levies, environmental taxes). All such taxes are subject to change without notice and are the responsibility of the traveller. Airline taxes will be confirmed at the time your airline ticket is issued.
12. Passports
All travellers must have a valid passport for international travel. Many countries require at least 6 months' validity from the date of return, and some countries require a machine-readable passport. We will assume that all international travellers booked will have a valid New Zealand passport; if this is not the case, you must inform us.
You are responsible for ensuring that you have valid passports, visas, and re-entry permits which meet the requirements of immigration and other government authorities. Any fines, penalties, payments, or expenditures incurred as a result of such documents not meeting requirements will be your sole responsibility, except to the extent caused by fault on our part.
13. Visas
If you need information regarding visas, passports, and other travel document requirements for your trip, please ask us. We can provide you with general information on visa and passport requirements that apply to international travel bookings, and can obtain more specific information from an external visa advisory service provider on your behalf. Fees will apply for such advisory services.
We do not warrant the accuracy of information provided by any external service provider and accept no liability for any loss or damage which you may suffer in reliance on it, except to the extent caused by fault on our part. We do not accept liability should you be refused entry into any country regardless of having a visa, except to the extent caused by fault on our part.
14. Travel Advice
We recommend that you consult the Ministry of Foreign Affairs and Trade SafeTravel service at safetravel.govt.nz for general travel advice as well as specific advice, including safety alert levels, relating to the destination you wish to visit. We recommend you register on the SafeTravel website so that you may be more easily contacted in an emergency.
15. Health
It is your responsibility to ensure that you are aware of any health requirements for your travel destinations and to ensure that you carry all necessary vaccination or health declaration documentation. We recommend you consult your GP or a travel medicine clinic well in advance of departure.
16. Loyalty Programme Memberships
Please advise us of all frequent flyer and loyalty programme membership details for inclusion at the time of booking. Check your frequent flyer membership and loyalty programme for the related specific terms. We cannot guarantee that the supplier will credit you with points for your booking. It is your responsibility to retain all boarding passes and other relevant documents as proof of travel.
17. Refunds
We are unable to provide any applicable refund to you until we receive the paid funds back from the relevant supplier. Refunds will be processed as soon as practicable, typically within 2–6 weeks of receipt from the supplier, though in some cases (especially international suppliers and cruise lines) this may take longer. Any refunds will be returned to you in the same way as the original booking form of payment.
18. Schedule Changes
Airlines, hotels, and other suppliers may, from time to time, make changes to schedules, routings, equipment, or accommodation outside of force majeure events. These changes are commercial decisions of the supplier and outside our control. Where we are notified of a material schedule change affecting your booking, we will inform you promptly and assist in arranging alternatives. Liability for changes rests with the supplier under their terms of carriage or service.
19. Sports and Event-Based Tours
High Performance Travel & Events specialises in tours built around sporting events, concerts, golf, and similar third-party events. The following additional terms apply to such bookings:
- Event cancellation, postponement, or alteration by the promoter: Where an event is cancelled, postponed, rescheduled, or materially altered by the event promoter or governing body, your refund or alternative arrangement is dependent on what the promoter and other suppliers refund or provide. We will work in good faith to recover the maximum possible amount on your behalf.
- Event tickets: Most motorsport, sporting, and concert tickets are non-transferable, non-refundable, and bound by the promoter's own terms. Ticket-only components may be excluded from refunds even where other components (e.g. accommodation, transport) are refundable.
- Seating, hospitality access, and grid positions: Where seating, hospitality areas, or trackside positions are specified in a tour, these are subject to availability and final allocation by the promoter. Where exact specifications cannot be honoured, equivalent or better alternatives will be substituted where reasonably possible.
- Weather and event conditions: Some events (particularly motorsport and outdoor sporting events) may be affected by weather. Decisions on cancellation, postponement, or partial running of events are made by the promoter. Travel arrangements remain valid where the event proceeds in any form.
20. Liability
To the extent permitted by law, neither NZ Travel Brokers Limited nor High Performance Travel Limited, nor any of their related bodies corporate, directors, employees, brokers, or agents accept any liability in contract, tort, or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense, or inconvenience caused directly or indirectly by the acts, omissions, or default — whether negligent or otherwise — of third-party providers over whom we have no direct control, force majeure, or any other event which is beyond our control or which is not preventable by reasonable diligence on our part.
Under circumstances where our liability cannot be excluded and where liability may be lawfully limited, such liability is limited to the remedies required of us under applicable law, including the Consumer Guarantees Act 1993. This liability clause is subject to your rights under the Consumer Guarantees Act and the Fair Trading Act 1986, and nothing in these terms and conditions is intended to limit any rights you may have under those Acts.
21. Force Majeure
In these terms and conditions, "force majeure" means any of the following: an event caused by war, government action, strike, lockout, other industrial disturbance or labour difficulty, variation in customs duties, act of God, act of public enemy, blockade, revolution, riot, insurrection, civil commotion, lightning, storm, flood, fire, earthquake, explosion, embargo, pandemic, public health emergency or government travel restrictions, substitution of goods, shortage of supplies, increased shipping or other freight charges, premium on overseas funds, unavailability of or disruption to communication networks, infrastructure or services, unavoidable accident, lack of transportation, or anything done by or to a person, government, or other competent authority, except the party relying on force majeure.
Treatment of client funds in a force majeure event: Where travel cannot proceed due to force majeure, we will work in good faith with suppliers to obtain the maximum possible refund, credit, or alternative arrangement on your behalf. Where refunds, credits, or alternatives are recoverable from suppliers, these will be passed to you, less any reasonable administration fees incurred by us in processing the cancellation and pursuing the refund. We are not obliged to refund amounts not recovered from suppliers.
22. Identity and Authority
We may require photo identification at the time of booking or before issuing travel documents, to verify the identity of the lead traveller and confirm authority to make bookings on behalf of any additional travellers in the booking.
23. Privacy and Personal Information
We collect, hold, use, and disclose personal information in accordance with the Privacy Act 2020 (New Zealand) and our Privacy Policy, available at highperformancetravel.co.nz/privacy-policy.

25. TAANZ Membership and Trust Account Protection
NZ Travel Brokers Limited, with whom High Performance Travel & Events operates in partnership, is a member of the Travel Agents Association of New Zealand (TAANZ). Client funds paid in connection with bookings made through us are held in the NZ Travel Brokers Limited Client Trust Account in accordance with TAANZ Code of Ethics and applicable trust account rules. This provides additional consumer protection over and above your statutory rights.
Details of TAANZ membership protection are available at taanz.org.nz.
26. Governing Law and Jurisdiction
If any dispute arises in relation to the agreement between you and us as constituted by these terms and conditions or otherwise, the laws of New Zealand will apply. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of New Zealand and waive any right that you may have to object to an action being brought in those courts.
27. Assignment
The parties acknowledge that no rights in respect of this contract shall be assigned to any third party.
28. Entire Agreement
The parties to this contract agree that these Terms and Conditions take priority over any other arrangements entered into via the parties. Neither party can rely on earlier written documents, or anything said or done by or on behalf of another party, before these terms and conditions have been agreed.
29. Variation
No variation of these terms or any of the agreements will be of any force or effect unless it is in writing and signed by each party to the agreement, or accepted via our client portal which records electronic acceptance with timestamp and identifier.
30. Signatory and Acceptance
The person signing or electronically accepting these Terms or any Quotation Summary, for or on behalf of the client, warrants that they have the authority of the client and any additional travellers in the booking to enter this contract. The person so signing hereby indemnifies us against all losses and costs that may be incurred arising out of failing to have such authority.
For the purposes of these Terms and Conditions, any documentation completed by way of email exchange or electronic acceptance through our client portal shall be deemed to be written acceptance of the contract terms.
